Led by industry veteran Robert McGirr and award-winning litigator Danielle Snell, we act for owners, builders, developers, building professionals, consultants, owners corporations and industry bodies.
We are known for representation at the Domestic Building Dispute Resolution of Victoria, the Domestic Building and Property List of the Victorian Civil & Administrative Tribunal, the County Court of Victoria and the Supreme Court of Victoria in relation to building disputes and claims including attendance at compulsory conferences, hearings and trials. We also represent building practitioners in regulatory and disciplinary proceedings.

Major Matters
Successful appeal to Building Appeals Board
Successfully acted for a family in relation to an appeal lodged by them to the Building Appeals Board concerning a lift they sought to have installed in their property to accommodate mother’s health condition which was objected to by the Council, but overturned after hearing on appeal to the Building Appeals Board.
Claim against building surveyor
Acting for a home owner in a claim brought against a private building surveyor concerning alleged negligent advice in relation to a luxury home renovation valued in excess of $12million.
Remediation costs dispute
Appeared on behalf of property developers in the Commercial Court of the Supreme Court of Victoria concerning a dispute about remediation costs under a contract of sale for a heritage listed former gasworks site in North Melbourne.

Barcrem Pty Ltd v Nisiotis [2019] VCC 1006
Successfully applied to the County Court of Victoria on behalf of property developers for a stay of proceedings on the basis that the proceeding was a “domestic building dispute” as defined in s54 of the Domestic Building Contracts Act 1995 [Vic]. Judgement was appealed to the Supreme Court of Appeal and ultimately settled before hearing.

Danielle Snell and the Elit Lawyers team acted for me on a high value insurance claim after insurers denied me all cover after my aircraft was damaged during the filming of a Hollywood movie. Given that insurers denied me all cover and offered to pay zero, with Danielle and team’s guidance, I issued proceedings in the Supreme Court of Victoria – Insurance List against the insurers involved. Danielle kept me well-informed and involved, ensuring I was aware of all my options throughout the legal process.
This was a stressful period for me, but I always felt confident and supported . I was happy to resolve the case prior to trial which involved a pay-out by the insurers.
